Buying at auction

A buyer’s premium of 20% applies to the hammer price on all lots.

Bidding is available in the room on sale day, live online via Invaluable (Invaluable’s own terms and any online surcharge apply to bids placed through their platform), or by absentee bid left with us via the online catalogue, by phone, or by email. Absentee bids are executed confidentially on your behalf, as cheaply as the room allows, never exceeding your limit.

Title to a lot passes to the buyer only once the full purchase price has been received. Payment and collection details are provided with your invoice after the sale.

Vendor Terms & Conditions of Sale

These conditions accompany, and form part of, every Vendor’s List issued by Moorabool Auctions.

1. Agency. We act as agent for the Seller in the sale of consigned goods and are not responsible for any default by the Seller or the Buyer. Title to a Lot passes to the Buyer only once the full Purchase Price has been received by us.

2. Seller’s commission. Our standard Seller’s Commission is 18% of the hammer price, deducted from your settlement proceeds.

3. Sales fee. We do not charge for lotting. A Sales Fee of $10 may apply to a small number of higher-value lots only, to cover the cost of selling through Invaluable. It is never applied to lots under $200.

4. No sale, no charge. If an item does not sell, no commission or fees apply.

5. GST. We assume the Seller is a private individual, not registered for GST, and that the sale of goods is a private sale not subject to GST. If you are registered for GST and require a GST invoice, please advise us prior to sale — GST will then be added to the Seller’s Commission accordingly.

6. Resale royalty (Australian art). Australian art may be subject to the Resale Royalty for Visual Artists Act 2009, where the sale price is $1,000 (inclusive of GST) or more and the artist was alive at any time within the preceding 70 years. Where applicable, any resale royalty commission will be added to the standard Seller’s Commission.

7. Estimates. Estimates provided are our opinion of a likely selling price range only and should not be relied upon as a representation of the price a Lot will achieve. Estimates will be discussed with you prior to the sale.

8. Reserves. A reserve price may be set on a Lot by agreement. We will not knowingly sell a Lot below its reserve, subject to a “one bid under” policy: the auctioneer may, at their discretion, accept a bid immediately below the reserve to secure a sale (for example, accepting $190 against a $200 reserve).

9. Auctioneer’s discretion. The auctioneer has sole discretion to refuse any bid, divide any Lot, combine two or more Lots, or withdraw any Lot from sale, without liability to the Seller.

10. Unsold lots. Unsold items will typically be offered for sale in a future auction at no additional cost, unless you request collection. We will contact you if an item remains unsold after reasonable attempts, to discuss re-offering or collection. Collection can be arranged at a mutually convenient time from our premises.

11. Post-sale offers. Where a post-sale offer is accepted on an unsold Lot, it will be at the reserve price plus buyer’s premium (20%). Our reserve is generally set around 25% above the figure needed to meet your net expectation, meaning a post-sale sale at reserve plus buyer’s premium should return you at least as much as, and typically more than, an equivalent result achieved under the hammer.

12. Insurance. Items consigned to us are covered by our insurance while in our care, unless otherwise noted for a specific item or circumstance.

13. Settlement & payment. On a successful sale, we deduct and retain the Seller’s Commission, any Sales Fee, and any other applicable expenses from the amount paid by the Buyer, before proceeds are remitted to you. Settlement is made by direct bank transfer within 7–28 days of sale. Please ensure we hold your correct account details. A settlement statement will be provided listing each Lot sold, hammer price, and deductions.

14. Condition of goods. Goods are consigned on the understanding that you have good title to sell them and that any description of condition, authenticity, or provenance you provide to us is accurate to the best of your knowledge.

15. Right to decline. We reserve the right to decline any item offered for consignment that we consider unsuitable for our auctions.

16. Acceptance. Consigning goods with Moorabool Auctions, whether in person, by post, or via our online consignment form, constitutes your acceptance of these Vendor Terms & Conditions in full.
